Extremely disappointing experience with Engaged Financial.
I signed a factoring agreement with Engaged Financial but never factored or funded a single invoice with them.
When I started operating, I decided to use another factoring company because I found that a number of brokers I wanted to work with would not accept Engaged Financial for factoring, which would limit my ability to work with those brokers. That was the main reason I decided to choose another factoring provider.
However, when my new factoring company contacted Engaged requesting a release/buyout, Engaged refused.
I repeatedly contacted my Engaged representative, Waleed Alvi, trying to resolve the issue. Engaged later confirmed in writing that my company has never funded with them, but they still refused to release my company.
I specifically asked them to address Section 10.1 of my signed agreement, but instead continued receiving essentially the same response: not eligible for buyout or release.
I even offered to pay an early termination fee just to resolve the situation. Engaged responded that no ETF was available and my company was not eligible for buyout or release.
For a small trucking company, this is extremely serious. Their refusal to release the UCC is preventing me from factoring with my chosen provider and is directly affecting my company's cash flow and ability to operate.
I tried repeatedly to resolve this professionally, including with Waleed Alvi and Engaged's Notices Team. I have now provided the agreement and communications to legal counsel for review.
Based on my experience, I strongly recommend that carriers carefully review Engaged Financial's termination and UCC provisions before signing, and also verify that the brokers they plan to work with will accept Engaged as their factoring provider.
