Raptors in Sheep's Clothing

I've reviewed a couple of legal packs from this company - unless spending a tedious (but necessary) time working through legal documents, buyers will not realise the many hidden fees associated with purchasing properties from McHugh & Co.

It seems that normally, there is an auction bid price that obviously has to be paid, then a fee to the auctioneer for their services in advertising the property and putting together legal packs. Most auctioneers gain double - a fee from both the buyer and seller for this.

Now, instead of overtly stating fees for any particular property being auctioned within the main property listing, this company appears to hide the costs within legal packs. The information is not 'hidden' per se, but neither is it readily available - unsuspecting buyers new to auctions might miss it until too late - when committed to a purchase, which is no longer as affordable but, for which they can do nowt abowt.

E.g.1:
On or before completion the Buyer shall pay the Seller a contribution towards the cost of any searches or disbursements including any indemnity policy, or any other search provided by the Seller whether in the auction pack or after exchange a sum of £650.00. The seller will not be providing an invoice and the General/Standard Conditions is varied accordingly.

E.g.2: In the event of the Seller serving Notice to Complete the Buyer shall as a condition of completion pay the Sellers solicitors costs of £750.00 plus VAT in relation to the service of notice. Any additional work incurred as a result of a failure to complete on time will be charged accordingly.

All prices are +VAT, therefore £650 is actually £780, and £750 is actually £900 (£1650 in additional fees already).

There are many other contract clauses e.g.: "The property is being sold with limited title guarantee save that for the purposes of Section 6(2)(a) of the Law of Property (Miscellaneous
Provisions) Act 1994 matters now recorded in registers open to public inspection shall be treated as being within the actual knowledge of the Purchaser", which effectively means:

The buyer is expected to perform their own due diligence by reviewing public records (e.g., land registry records, local authority searches). If any adverse matters are found in these public registers, the buyer cannot claim to be unaware of them after the purchase is completed. The limited title guarantee also means the seller is not liable for title defects that arose before their ownership of the property unless explicitly disclosed.

In short, the buyer is responsible for checking public records and assumes the risk for any issues that could have been discovered in those records.

It goes on and on and on.

Legal eagles (raptors) of course gain benefit from this - I'm sure the owner(s) are lawyers - not content with gaining sales fees (from both buyer and sellers), they additionally gorge on other extras and then, as added security for themselves, tie prospective buyers in legal jargon, knowing most, if any will not proceed to court about it - and if they do, there's lots of ambiguity - more food for lawyers.

I would like to highly recommend McHugh…

I would like to highly recommend McHugh & Co to anyone who is thinking of selling property at Auction. I realised my best option to sell my flat was to go to Auction and a friend of a friend who had years of experience working in the North London’s property market suggested and recommended I used McHugh & Co. As a person who was totally new to selling at Auction, I received all the information, and had all my questions and queries answered by the extremely professional, helpful and patience staff at Mc Hugh’s - especially Marino Costi.
Marino always responded quickly to all my phone calls and emails, and gave very good advice and support throughout the whole process.
Everything went exactly as I wanted - a very good result.

Recently bid on a house

Recently bid on a house, Gladly i lost the auction, but was shown the bidding by a friend, auction due to finish at 12.00. On a bid of 75k, Only one bid, they then extended the auction progressively for the next 1,5 hours, no other bids till 1pm, and them the bidding went up, only one other bidder who won,
I was told after they bid on there own auction so they won there own auction,
They pray on cheap auction and resell and bid this way to make money, they them throw up lavish additional addins to make you pay even more, so once you win the bid, expect to pay over 8k more on top,

Avoid dealing with McHugh & Co

Avoid dealing with McHugh & Co. especially if you have no experience buying on auctions. They work with some seriously dodgy sellers and their legal pack is like a minefield - especial "special conditions" part. Buyer will end up paying ALL seller's fees and more ( buyer even pays seller for things like EPC ...). They don't use digits when mentioning additional costs hoping that potential buyer will miss that part. There will be over £15K additional fees for a buyer + regular fees that you would expect when buying on auction. They do not issue any invoices or receipts, how this is even legal? Properties are not even registered in sellers name. Guide price is a joke, bidding actually starts £10k above the gp. They keep extending auction time by 2min, by 10min, by 5 min - at the end auction ended 40 min late. There is so many things wrong with this place its scarry, stay away unless you really know what you're doing.

As per other reviews, ridiculous seller’s fees and a buyer’s premium to be paid without a receipt! How do they allow that sort thing to take place via their platform?

Also, baffled why they charge the buyer a fee of £1k because they repeatedly fail to help with any query, their go to predictable response to most things tends to be “you need to contact the seller’s solicitor yourself about that”.

It was my first property auction and if this is how it is, never again ;(

Why does McHugh move the end auction…

Why does McHugh move the end auction times? Never had this before and sense underhand activities. Using preceding lots overrunning as an excuse when everything is electronic is very suspicious. Not trustworthy.

The reply below regards T&C’s is not a reflection of what happens. No bids was placed like in the T&C’s and yet the clock keeps moving further away. Only if a bid happens to stop snipping unlike eBay it states with the process be moved by just over a min. Nobody bid and yet the clock gets moved all the time. No other property auction does this. Sorry, the T&C’s are very misleading.

Please do not take my review offline. McHugh called me to advise why they do it because apparently there own system cannot cope with so many properties all ending at the same time. So like I said, why put so many with the same start time. We know why they really do it - so if no bids and another bidders misses out on another property, they then move onto another property to bid as the clock keeps pushing away. They also advised eBay does the same - but they do NOT do the same. I will say it again to refresh this post in case Mchugh want it removing. BE VERY CAREFUL using this auction company as the goal posts WILL move

We would like to clarify that the seller fees you refer to are not associated with ourselves and are paid to the seller’s solicitor on completion. We state in our buyers guide which each customer receives a copy of when registering for the auction and on every lot page on our website - The seller may charge additional fees payable upon completion. If applicable, such fees are detailed within the special conditions of sale. Buyers are deemed to bid in full knowledge of this.

The worst experience the worst…

The worst experience the worst nightmare anyone could experience.

I went online looking for a garage in East London and came across Mchugh Auctions. Stupidly I decided not to ask friends or family for their advice and went online registered and paid the 5k deposit to make bids.

Saw 2 flats and decided to bid for them. I realised on the day something wasn’t right as the prices went really high, felt it was like it was being done internally but still decided to go ahead. Both flats went for 30k each.

On their portal it says solicitor fees would be either 2.5% or SEVEN AND HALF THOUSAND POUNDS. Stupidly the 7.5k are not written numerically so it can be missed, for me it was the case. When you call up and speak to someone in their office and ask what are the fees their tone will change and they will say they are not sure and one must check on the lot.

After the purchasing the flats I also realised, that certain documents were not present and there was a daily charge on the property of £10 which is totally fuckery.

I called up Mchugh Auctions to have the flats relisted on their site and was told quite bluntly no. When I insisted why I couldn’t, I was put on hold and told again there wasn’t enough time to have them advertised on the catalogue. A blunt response, they had enough time to list as they had all the details of the flat and the legal documents.

I have wasted 90k on 2 flats which are worthless. When you make a bid, you are not bidding against a person who has the same desire to buy like you to buy but bidding against a Mchugh employee who are increasing the price. When Mchugh Auctions realise the mark isn’t going to bid no more and it’s going to be won by themselves, the property is then thrown back in auction for their next auction date. If you look at their auction winning history, you will find many investments appearing again and again.

I made many mistakes, all the negative comments I have seen online have happened to me. I made so many errors but please don’t make the same mistakes as me.

I also saw another investment which was a walkway ownership in Tower Hamlets, guide price of 1k, I feel so happy I didn’t get it or bid. It would have cost me 7.5k in solicitor fees, 1k fees to Mchugh which is their front. Probably another 3k fees to get the legal documents. By the time I would have got the land it would be another fuckey of daily charges.

A truly dishonest company, do not put your trust in this company to buy or sell your property. I wish I could go back and think it all through.

McHugh has no integrity as an agent

McHugh has no integrity - Exceptionally misleading listing for a garden in enfield - no mention of the multiple planning turn downs or the private water main and sewage with the delightful mockup of 3 houses - latest planning turn down was just less than a month before listing the garden at an astonishing price - sadly the rose-tinted listing has resulted in many strange people visiting a private road and breaking into the gardens - no integrity at all and very misleading

Highly misleading auction guide prices

Their auction guide prices are dramatically undervalued - every lot in today's auction has attracted considerably higher results than the guide price. The guide price for the one I was interested in was increased by the auctioneers less than 24 hours before the auction began. Thankfully I hadn't invested any money in solicitors, etc... Such practices makes me think they're undervaluing their guide prices just to get people's attention. Wish I'd read the negative reviews on here before registering as this is not an isolated incident. Don't waste your time unless you're willing to spend considerably more than the guide price. Buyer Beware!

Sadly everything other reviews have sited are 100% correct ...the Legal Pack is a joke with vital information missing only response will be get indemnity insurance
Try finding out info from utility companies etc and they site GDPR
Any properties marketed by this company should be viewed with deep suspicion of all manner of hidden faults , debts, covenants , agreements that will only be expensively revealed after purchase thankfully i sussed the scams .

AVOID!!

AVOID!!! They are a con. They don’t tell you about hidden fees which is there but cleverly disguised with words rather than digits. Once you pay there £1k they brush you off! I ended up paying 6k extra to the seller which wasn’t mentioned at the time of buying also have to pay the sellers solicitors fee! The house we Bidded on and won had subsidence and the legal
Pack said solid foundations no problems. Unfortunately, You will not get a mortgage and then after the problem is fixed you won’t get a mortgage for another 6years. The House was valued at zero. None of this was mentioned. Plus the seller brought this property 3 months ago which was not mention as mortgage company’s won’t lend. This has caused us so much stress. This was our first and unfortunately will be our last auction. AVOID auction properties not worth the stress! AVOID Mchughs because after the sale they won’t help. We lost 10% and more on searches and fees. This 10% needs to be more regulated. Lots of buyers have lost out ! Please read reviews
