Deposit withheld unlawfully after clean outgoing inspection — pattern of non-compliance over 12 months
I rented a property managed by Property Partners for 12 months. The outgoing inspection on 30 April 2026 recorded no defects or damages, yet my deposit was not returned within the 7-day period required by the Rental Housing Act.
When I sent a formal letter of demand, I received a series of delaying responses citing internal processes and the need for owner approval — none of which are valid legal defences. The agency's position appeared to be that it could not act without the owner's instructions, which is inconsistent with its independent obligations as a registered property practitioner.
This was not an isolated issue. During the same tenancy I had to involve the Western Cape Rental Housing Tribunal to enforce maintenance obligations, again resolved in my favour.
I have filed complaints with the Rental Housing Tribunal and the PPRA. If you are considering using this agency, be aware that you may need to take formal legal steps to enforce your basic rights as a tenant.
