Tenant Rights Violations: A Case Against Freedom Property

Violations of Tenant Rights by Freedom Property.

Freedom Property’s handling of residential leases reveals serious irregularities that violate tenants' fundamental rights as outlined in the Residential Tenancies and Rooming Accommodation Act 2008 (RTRA Act). The following account details a series of significant breaches that must be addressed to uphold the rights and dignity of tenants:

1. Unjustified Withholding of the Security Deposit
The security deposit (bond) is a resource protected under Australian law to safeguard the interests of both landlords and tenants. These funds are administered by the Residential Tenancies Authority (RTA) in Queensland and must only be withheld in cases of proven damages, unpaid rent, or specific breaches of the tenancy agreement.
In this case, the agency unjustifiably withheld the deposit despite compliance with all contractual obligations, including cleaning standards, payments, and proper handover. This is a direct violation of tenants' rights, and such conduct is subject to legal sanctions under the RTRA Act. Evidence such as inspection reports and cleaning receipts will be provided to substantiate compliance.

2. Failure to Maintain a Habitable Property
Under the law, landlords and their agents must maintain the property in a safe and habitable condition throughout the lease term. Freedom Property failed in multiple respects:

- Kitchen Appliances: Four out of five stovetop burners were non-functional when the property was delivered, and the oven became utterly inoperable due to its age and poor condition. Despite repeated requests for repairs, the agency failed to address these essential issues, forcing us to live without a fully functional kitchen for three months. Evidence, photos, videos and emails

- Air Conditioning: During the peak of the Queensland summer, when temperatures reached 39–45°C, the air conditioning system completely failed. We endured extreme heat for two months, an unbearable situation exacerbated by the presence of our Alaskan Malamute, Lachlan, a breed susceptible to high temperatures. The landlord’s failure to promptly repair the system breached their duty of care and exposed us to unnecessary physical and emotional hardship. Evidence team to fix the issue

- Flooding Due to Poor Drainage: The property’s garden and surrounding areas consistently flooded during heavy rains, a frequent occurrence in Gumdale, Brisbane. This led to water stagnation, damaging plants and the garden and adversely affecting our overall living conditions. The agency’s failure to address these drainage issues further compromised the property’s habitability. Evidence, photos, videos and emails.

3. Unaddressed Infestations and Environmental Hazards
The property was plagued with toads, lizards, and snakes, which presented significant safety and health hazards. Despite notifying the agency, no proactive pest management measures were implemented. Such negligence demonstrates a disregard for the landlord's obligation to ensure a safe living environment as stipulated in the tenancy agreement.
We also request that the drinking water be tested, as my wife and I have become increasingly ill from drinking the tap water, which also smells. In January, we gave up trying to contact the agency over the phone about the water due to their neglect regarding the air conditioning and oven issues. These problems were eventually fixed and documented as broken by engineers after months of emails, showing the need for replacements due to age.

4. Privacy Violations Through Unauthorized Use of Images
A photo of the property, including our personal vehicle, was uploaded to Google without our consent. We were not asked for permission for our car to appear in this image, raising significant privacy concerns and potentially breaching Australian privacy laws. Despite requesting the removal of the image, the agency failed to act. This oversight highlights a lack of respect for tenants' privacy and a disregard for consent protocols in the public use of images.

5. Increased Financial and Emotional Burden
The cumulative impact of unresolved maintenance issues, environmental hazards, extreme heat, and privacy violations created significant financial and emotional strain. Additional costs incurred from dining out due to the non-functional kitchen and the stress of living in an unsafe and uncomfortable environment detracted from what should have been a secure and peaceful home.

6. Inaction Leading to Unnecessary Litigation
This unnecessary step reflects the agency's lack of professionalism and disregard for tenants' rights.

Nicole Mcgregor of freedomrentcare.com.au has continually lied to her clients. She has falsely accused customers of damaging property, which is also 100% fabricated.

In January, Queensland, the air conditioner had not worked correctly for two months in summer, and we had been without a working oven or gas top for over twelve weeks. Freedom fixed these issues only after filing a motion to go to court.

Nicole has published false information to other agencies and will face the ACCC.

This has to be the most disrespectful real estate agency I have ever encountered in 20 years of renting.

I am now a partner in a construction company building cost-affordable housing. Don't hesitate to contact me if you want to read the email correspondence on the airconditioning, oven and gas, which took over 3 months to fix as evidence. For example, my wife had no stove or gas for 12 weeks.
